Age limit lowered for partners of Australian skilled visa applicants:

Recent changes to qualified permanent visa include a reduction in the maximum age allowed for requesting partners. In the past, five additional points, often in desperate need, were available to visa applicants for general skills where the spouse or actual partner was under 50 but was 45 years old.

What brought about this reduction?

The amendments to the migrant law provided for the lowering of the maximum age at which claimants could claim the five points, but the amendments failed to include applicants' partners. The latest changes only correct this oversight. From now on, the applicant and his partner must be under 45 years of age "at the time of the invitation".

Which visas are affected?

These amendments came into force on Feb 1, 2019 and apply to qualified independent visas, subclasses 189 and 190 (permanent visas), plus the qualified regional visa, subclass 489 (which provides access to permanent residence).

Why were age limits reduced?

The Department justifies its decision to reduce maximum age limits based on the fact that the younger population will be more beneficial to the Australian economy. The Department determined that older residents tended to have lower participation rates in the labor force and, earlier, to contribute to the rising costs of government-subsidized health care and support services.

Substantial impact for more mature applicants:

Since the migration of Australian workers is closely linked to a rigid point-based system (apart from employer-sponsored worker migration), the latter modification creates a significant challenge for applicants whose spouse is over 45 years of age. Points are awarded on the basis of age and are calculated on a sliding scale; then education, work experience, proficiency in English, etc.

 A five-point bonus is available for a state application, but each candidate must obtain a minimum of 70 points in total to be considered a chance of success.Additional options exist, such as the NAATI CCL test which offers five additional points.
